Can a health insurance company refuse you a policy in NYS?

Thanks to the Affordable Care Act (obamacare), you can only purchase health insurance during open enrollment (Nov-Jan) or if you have a qualifying event.
You can't purchase coverage now, just because you want to.
During open enrollment there are currently no situation where you can be denied coverage unless you aren't a US resident or something similar.

Right now, they cannot sell you a policy without a qualifying event...

They cannot decide not to let you have a policy. This does not mean that they have to give you one. It just means that it is not their decision.
Either they have to let you have one -- or they can't let you have one. Either way, it is not up to them.
